The Epstein deal was made under the Bush administration. Federal prosecutors signed the non-prosecution agreement in September 2007, and Epstein pleaded guilty under it in June 2008, before Obama took office.
The Justice Department's Office of Professional Responsibility found that the U.S. Attorney's Office for the Southern District of Florida negotiated a state-based resolution 'which culminated in the signing of the NPA on September 24, 2007', and that 'on June 30, 2008, he appeared in state court and pled guilty' (DOJ OPR, Executive Summary of Report on the Epstein investigation, November 2020).
