The statements were not flawless. An appeals court found they valued Trump's Trump Tower triplex at 30,000 square feet when it measured 10,996, and left the liability finding in place.
The Appellate Division's August 21, 2025 decision vacated the disgorgement awards and otherwise affirmed the judgment, leaving the liability finding in place. Its lead opinion found that Trump's statements of financial condition for 2011 to 2016 valued his Trump Tower triplex on a size of 30,000 square feet, although it measured 10,996 square feet, the size recorded in a 1994 condominium filing that Trump himself signed. The justice who would have dismissed the case also wrote that defendants did not contest that they had represented the triplex as 30,000 square feet (People v. Trump, App. Div. 1st Dept.).
